I have went back and forth about posting this and have decided that other landowners on here probably should be warned about this guy. I have removed his name from the other thread where I was talking about it and won't say it on a public forum but if you think it is him answering your lease post I will confirm in private message. So on to the story...
Last year in February I decided to lease out the 293 acre farm we have in Benton county. It is really a unique property in it's location and all it has going for it. It is truly a year round recreational property, not just a hunting lease. It has a very nice 3 bedroom 2 bath house on a full dry basement with a garage door where you can store atv's, boats, etc. It has a membership to the Eagle Bay resort which includes use of the Eagle Bay private boat ramp to Lake of the Ozarks and use of the Eagle Bay swimming pool. The farm is mostly timber, there is one open 10 acre field which I have tilled and planted in soybeans in the past and three other approximately one acre food plots. The farm was logged about 5 years ago and the resulting undergrowth has created a TSI effect on the property. There is a year round live running spring fed creek along one side. No hunting pressure to speak of anywhere around it and the deer and turkeys are thick. There is an extensive trail system most of which can be traveled in a pickup.
I posted the farm on here in the for lease section for $12000 a year. I got a few replies wanting to lease it just for deer or turkey but I was really looking for someone wanting a full year recreational lease. It is very close to Lake of the Ozarks and just a mile from Walter's Ranch ATV park. With the nice house and swimming pool it is suitable for a year round family deal. So I get contacted by this guy from Michigan. Very excited about it, gives me a whole spiel about being involved with an outdoor non profit group that provides hunting experiences for disabled hunters etc, etc. He wants the farm. They also lease a farm somewhere in NW missouri, I believe in Gentry or Davies county. He asks if the payments can be broken up into three payments and I agreed. The first was to be paid immediately, the second due June 1st and the third due October 1st. I sent him a lease agreement with this all spelled out.
He informs me that he wants to come see the property and will bring signed lease and first payment when he comes. We set a date to meet at the property on a saturday in the middle of March right before I was coming back to Florida to start my fishing season. The week before our meeting we exchange several texts about directions to the property, places to eat, etc. He is leaving Friday and driving all day, staying at their lease in NW MO that night and meeting me saturday afternoon. I leave my house in Blue Springs and go to my farm at Stover which is near the other farm and do a few things while waiting for him to call that he is in Cole Camp so I can meet him at the farm. I get no call. By 2pm I text and see if he is still coming. No reply. I text several more times and try to call, no answer, no reply to text. Finally at dark I head back to Blue Springs having wasted an entire day that I could have spent doing other things critical to me going back to Florida. Finally at 10pm Saturday night he texts me and tells me he hit a pothole coming through Chicago on Friday and ruined a tire and wheel on his truck and was stranded waiting on someone to bring him another tire and wheel. We would have to reschedule.
Well, I am heading back to Florida because I have charters scheduled so I tell him that. He asks what part of Florida and I tell him Destin. He says he is taking his family to Pensacola in April for a vacation. I tell him that's just an hour from me and I would drive over to Pensacola and meet him, sign the lease and pick up the payment. He says that would be great. He texts me all excited the entire week before he will be in Pensacola. He texts me when they arrive in Pensacola and I try to set up a day to meet. Well, his wife has a bunch of stuff planned and he isn't sure when he can work it in. I tell him this doesn't have to be a long drawn out affair, 15 minutes for us to meet, sign the lease, I give him some maps and he hands me a check. Well supposedly they are in Pensacola for two weeks and he couldn't manage 15 minutes to meet with me. So that doesn't work out. I tell him I think I will just lease it to someone else, turkey season is about to open and I think I can still at least lease the hunting. He calls me and begs me not to lease it out, he will mail a check.
I wait a week and check doesn't come. I text him. Check on its way. I wait another week, no check. Try calling, no answer, text him, he gets back next day. Wife forgot to mail check. I get excuse after excuse but when I tell him I am going to lease it out he swears he will send money. Finally turkey season is past so I have missed that opportunity. I know I should really cut him loose but my other option is to rent the house and lease out the hunting which is going to cause a whole lot of wear and tear on the house. This is really a sweet deal for me because I am getting a pretty good chunk and the house will only be used a few weeks a year. So I keep on with the guy. Finally after about the 4th time of him telling me a check was on the way I tell him if I don't have the check by June 1 I am renting it to someone else. I finally receive the first payment check on May 30th. I tell him the next payment is due on July1 just a month away and he asks if I would let him make it on July 31st. I had just got some money out of him so I tell him ok I will agree to that.
July rolls around and I start texting him about the 15th to remind him he has a payment due on the 31st. "Yep Boss, got it covered, you will have it on time!" is his reply. I text him on the 24th and ask if he has sent it yet. No answer. I try to call the next day, no answer. Finally get a reply. At the Mayo clinic with sick daughter. I am sympathetic. I tell him to take care of his family and just get me the payment as soon as he gets home. A couple of weeks go by so we are into August. I text again, inquire about daughter. No answer. A few days go by, finally get an answer, still at mayo with daughter, doesn't have check book. I am getting a little frustrated and tell him I assume his other bills are all getting paid while he is out of town and offer to give him my wiring information so he can arrange to wire the payment. He doesn't want to do that. After a couple of more rounds of check is on it's way I demand that he text me a picture of the check and a tracking number or I am going to lease it to someone else. Still trying to get a signed copy of the lease from him too. He finally texts me a pic of the check and tracking number and I get it around September 1.
I tell him that I will not allow them to hunt the farm until I receive the last payment. He assures me I will have it. On monday before rifle season opens on Saturday he asks me if I know where they can get some furniture for the house, he has hunters arriving on Friday to hunt the weekend. I have a property manager for my rentals that furnishes some of them so I have him put together a price on a full package, everything from furniture and beds to linens, silverware, cooking utensils, pots, pans, tv, dvd player, everything they need to stay there except food. I send him a price and he agrees. I give him my property managers name and contact info and tell him to just pay him directly. He has also assured me that my final payment has been sent out. He isn't at home and the tracking number is on his desk. Going to see if his dad can go take a pic for me. Anyway, you know what's coming, check never showed up. Hunters came and hunted, killed a nice deer, stayed about 4 days, left the house in a mess and left. Never paid for the furniture.
I called, texted, left messages, no reply or return for several days. Then I get a text from his wife supposedly. The guy collapsed and has kidney failure, in the hospital in dire condition. Promises they will get me paid but have to take care of him. This goes on for several weeks. My property manager is now on me to pay for the furniture and threatening to start charging interest at 19%. I go through weeks of BS with the wife,(or who says is the wife) sending her amounts, where to send check, etc, etc. It's on the way, it got returned to them, she forgot to mail it. I finally just gave up and told them it's over, I give up. Don't ever contact me again.
So I have really condensed this down, there were lots of other events, he cut his hand at work and had to have 60 stitches, his mother was in the hospital, his daughter was in the hospital, he was out of town for work. I played along with this for so long because I really didn't want to rent the house to a full time renter and have the wear and tear on it. I kept telling myself this is a sweet deal, even if he is a pain to get the payments out of. So I let it go a lot longer than I normally would have put up with. I learned a lot from this and fortunately didn't come out of it too bad. I got enough out of the guy to cover the taxes and pay for the furniture but I put up with a lot of lies and excuses!! I know I should have not went any further than him missing the first payment.
